$1,000,000 Award Upheld By Appeals Court
BWO recently obtained a workers’ compensation Award for our client valued at more than $1,000,000. The Award came after a hearing in front of a workers' compensation judge in Joplin, Missouri at the Missouri Division of Workers' Compensation.
Our client's husband was killed in an automobile accident outside of Neosho, Missouri while traveling for work. The employer and insurance company refused to provide any benefits to our client, which she was entitled to under Missouri law as the surviving spouse.
After a hearing, the Judge ordered the employer and insurance company to pay our client benefits valued at $1.09 million dollars. The case was reported by the newspaper Missouri Lawyers Weekly.
The employer/insurer appealed the Award, first to the Labor and Industrial Relations Commission, and then to the Southern District of Missouri Appellate Court. We were successful on both appeals, and the employer/insurer then asked the Missouri Supreme Court to review the case. The Missouri Supreme Court refused, and the Award in excess of $1,00,000 to our client was upheld.
This was a great result for a great family that had suffered an unfortunate tragedy.
